EB-2

 Overview

Immigrant visas from this preference category is available to the following 2 types of foreign nationals, provided that the employer can show that there are no qualified U.S. Citizens or Legal Permanent Residents to fill this position:

   

  • The foreign national is a member of a profession requiring an advanced degree, or
  • The foreign national has (1) exceptional ability in the sciences, arts, or business, so that his contributions will substantially benefit the national economy, cultural or educational interests, or welfare of the U.S., and (2)  an employer in the U.S. seeks him for his services in the sciences, arts, professions, or business

Please note that the USCIS has stated that the mere possession of a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning or a license to practice or certification for a particular profession or occupation is not sufficient evidence to prove such exceptional ability.

National Interest Waiver

The National Interest Waiver (NIW) is available for physicians seeking to work in approved shortage areas or veterans facilities.  If granted, the NIW allows the physician to immigrate to the U.S. without a job offer. 


What We Can Do For You
  • Obtain PERM Labor Certification from the Department of Labor to show that there are no qualified authorized workers within the United States
  • ​​Determine whether your priority date is current
  • Help you gather all available evidence to show that you or your employee qualifies for EB-2, either as a member of a profession requiring an advanced degree or as someone of exceptional ability
  • Complete and file Form I-140 and Form I-485
  • ​Apply for the National Interest Waiver, if applicable
  • Respond to any Requests for Evidence, if required
